Policy

These Terms & Conditions apply to the use of the GAP Coaching website and to coaching services provided by GAP Coaching / Gareth Allen (“we”, “us”, or “our”).

By using this website or engaging our coaching services, you agree to these Terms & Conditions.

1. About GAP Coaching

GAP Coaching is a performance coaching service operated by Gareth Allen.

Our services include coaching designed to support individuals, business owners and leaders with areas such as:

  • Business performance
  • Leadership
  • Goal setting
  • Accountability
  • Personal and professional development
  • Resilience
  • Performance improvement
  • Business planning and focus

The specific services provided will depend on the requirements agreed with each client.

2. Coaching Services

Coaching is a collaborative process.

We will work with you to identify objectives, explore challenges, develop actions and provide accountability and support.

Coaching is intended to help you make your own decisions and take responsibility for your actions.

We do not guarantee that coaching will result in any particular business, financial, career or personal outcome.

Results will depend on a number of factors, including your circumstances, commitment, decisions and actions.

3. No Guarantee of Results

While we aim to provide high-quality coaching and practical support, we cannot guarantee specific results.

Any examples, testimonials or statements about potential outcomes should not be interpreted as a promise or guarantee of a particular result.

You remain responsible for your own decisions, actions and outcomes.

4. Coaching Is Not Professional Advice

Unless expressly agreed otherwise, GAP Coaching does not provide legal, financial, medical, psychological, accounting or other regulated professional advice.

Information discussed during coaching should not be treated as a substitute for advice from an appropriately qualified professional.

Where a matter requires specialist advice, you should seek advice from a suitably qualified professional.

5. Consultations

We may offer an initial consultation to understand your requirements and determine whether our coaching services are suitable for you.

A consultation does not automatically create a coaching agreement.

Any ongoing coaching arrangement, fees and services will be agreed separately where applicable.

6. Appointments

Where a coaching session or consultation has been arranged, you are expected to attend at the agreed date and time.

If you are unable to attend, please provide reasonable notice wherever possible.

We reserve the right to charge for missed appointments or late cancellations where this has been agreed as part of your coaching arrangement.

Any specific cancellation terms agreed with you will take precedence over this general provision.

7. Fees and Payment

Fees for coaching services will be communicated and agreed with you before paid services begin.

Where payment is required, payment must be made using the method and within the timeframe agreed with you.

If an invoice remains unpaid, we reserve the right to suspend or terminate coaching services until payment has been received.

Unless otherwise agreed in writing, fees are non-refundable for coaching sessions that have already been delivered.

Any applicable cancellation or refund arrangements will be communicated before you commit to paid services.

8. Client Responsibilities

To get the most from coaching, you are responsible for:

  • Providing accurate information
  • Being open and honest during coaching sessions
  • Attending agreed appointments
  • Completing agreed actions where appropriate
  • Making your own decisions
  • Taking responsibility for implementing agreed actions
  • Informing us of any circumstances that may affect the coaching relationship

We cannot be held responsible for outcomes resulting from a client’s failure to act on agreed recommendations or actions.

9. Confidentiality

We respect the confidentiality of information shared during coaching.

Information provided by you will not normally be disclosed to third parties without your permission, except where:

  • Disclosure is required by law
  • Disclosure is necessary to comply with a legal obligation
  • We reasonably believe disclosure is necessary to prevent serious harm
  • Disclosure is necessary to protect our legal rights or interests

If coaching is provided to employees or members of an organisation, separate confidentiality arrangements may apply.

10. Intellectual Property

All original materials provided by GAP Coaching, including written materials, documents, frameworks, exercises, website content, graphics and other resources, remain the intellectual property of GAP Coaching or the relevant rights holder unless otherwise stated.

You may use materials provided to you for your own personal or business development purposes.

Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.

This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

15. Ending the Coaching Relationship

Either party may end an ongoing coaching relationship in accordance with any specific agreement between the parties.

We may suspend or terminate services where:

  • Fees remain unpaid
  • A client repeatedly fails to attend agreed sessions
  • The coaching relationship is no longer appropriate
  • A client behaves abusively, threateningly or inappropriately
  • Continuing the relationship would create a legal, ethical or professional concern

Any outstanding fees for services already provided will remain payable.
